PRELIMINARY INFORMATION FORM

ARTICLE 1 - PARTIES AND SUBJECT MATTER

The subject of this Preliminary Information Form is to inform the BUYER and SELLER regarding the distance contract in accordance with the provisions of the Law on the Protection of Consumers and the Distance Contracts Regulation. In addition, information regarding the issues in Articles 5/1 a, d, g and h in accordance with the Distance Contracts Regulation is included in this Preliminary Information Form.

ARTICLE 2 - DEFINITIONS

In the application and interpretation of this agreement, the terms written below will express the written explanations opposite them.

Product or Products	:	It refers to the movable goods, real estate for residential or holiday purposes, and all kinds of products such as software, sound, image and the like prepared for use in electronic environment.

Cargo Company to Which the Buyer Can Send the Goods to the Seller in Case of Return		If the return is sent via Yurtiçi Kargo, no shipping costs will be requested from the BUYER. If the returned product is sent via a different shipping company, the shipping costs will be the BUYER's responsibility.

ARTICLE 5 - BASIC CHARACTERISTICS AND PRICE OF THE GOODS AND SERVICES SUBJECT TO THE CONTRACT (VAT INCLUDED)

5.1. The basic features of the Goods/Products/Products/Service (type, quantity, brand/model, color, number) are available on the SELLER's website www.masumaceramics.com.tr . The basic features of the product are available on the relevant page where the product is advertised, on the order summary page and below.

5.2. The prices listed and announced on the site are the sales prices. The announced prices and promises are valid until updated and changed. The prices announced for a limited period are valid until the end of the specified period.

5.3. The sales price of the goods or services subject to the contract, including all taxes, is shown in the table below.

5.4. All additional charges such as taxes, duties and fees related to the product will be paid by the SELLER.

5.5. The shipping fee, which is the cost of shipping the product, will be paid by the BUYER. 

5.6. The shipping fee is included both on the relevant page where the product is advertised and in the payment area.

ARTICLE 6 - RIGHT OF WITHDRAWAL

6.1. In contracts regarding the delivery of goods/products, the BUYER may return the goods/products by exercising his/her right of withdrawal within 14 (fourteen) days from the delivery of the goods to him/her, without giving any reason.

1. a) In calculating the period for the right of withdrawal, for goods that are the subject of a single order and delivered separately, the day on which the BUYER or a third party determined by the BUYER receives the last goods,
2. b) For goods consisting of more than one piece, the day the BUYER or a third party designated by the BUYER receives the last piece,
3. c) In contracts where the goods are delivered regularly for a certain period of time, the day on which the BUYER or a third party determined by the BUYER receives the first goods is taken into account.

6.2. The BUYER sends the notification of the use of the right of withdrawal to the SELLER. The SELLER is obliged to refund the price of the goods/product within 14 (fourteen) days from the receipt of the BUYER's declaration of withdrawal.

6.3. The refund of the price of the goods/services in question will be made in accordance with the payment method used by the BUYER during purchase, without any expense or liability to the BUYER.

6.4. The BUYER shall send the goods back to the SELLER within 10 (ten) days from the moment the notification regarding the right of withdrawal is sent to the SELLER.

6.5. The BUYER shall not be responsible for any changes or deteriorations that occur if the product is used in accordance with its operation, technical specifications and usage instructions within the withdrawal period.

6.6. As long as the BUYER sends the goods/products to the SELLER with a DOMESTIC cargo company that the SELLER has an agreement with, the return shipping fee belongs to the SELLER. If there is no branch of the SELLER's contracted cargo company at the BUYER's location for the return, the BUYER may send it with any cargo company, in which case the shipping fee belongs to the SELLER. If the BUYER sends the goods to be returned with a cargo company other than the SELLER's contracted cargo company, the SELLER is not responsible for the return shipping fee and damage to the goods during the shipping process.

6.7. If the invoice is included with the goods, the relevant return section must be filled in and signed by the BUYER, and the invoice, return form and cargo delivery report must be delivered.

6.8. With the exercise of the right of withdrawal, the side contracts between the BUYER and the SELLER are terminated without any obligation to pay expenses, compensation or penalties.

ARTICLE 7 - CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

7.1. BUYER cannot exercise his right of withdrawal in the following contracts:

1. a) Contracts for goods or services whose prices change depending on fluctuations in financial markets and are not under the control of the SELLER.
2. b) Contracts regarding goods prepared in line with the consumer's wishes or personal needs.
3. c) Contracts for the delivery of goods that are perishable or may expire quickly.

ç) Contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable for health and hygiene reasons.

1. d) Contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature.
2. e) Contracts regarding books, digital content and computer consumables presented in material form, if protective elements such as packaging, tape, seal, package have been opened after delivery of the goods.
3. f) Contracts regarding the delivery of periodicals such as newspapers and magazines other than those provided within the scope of the subscription contract.
4. g) Contracts regarding accommodation, transportation of goods, car rental, food and beverage supply and the evaluation of free time for entertainment or recreation purposes, which must be made on a specific date or period.

g) Contracts regarding services performed instantly in electronic environment and intangible goods delivered instantly to the BUYER.

1. h) Contracts regarding services that are started to be performed with the approval of the BUYER before the expiry of the right of withdrawal period.
